Terms & Conditions – TheCru.ie

These Terms & Conditions apply to your use of TheCru.ie and to orders placed through our website. Please read them carefully before placing an order.

Nothing in these Terms & Conditions limits or affects your statutory rights under Irish or EU consumer law.

2. Age Restrictions – Alcohol Sales

You must be 18 years of age or older to purchase alcohol from TheCru.ie.

By placing an order containing alcohol, you confirm that you are legally entitled to purchase alcohol and that the person receiving or collecting the order will be aged 18 or over.

Proof of age may be requested when an order is delivered or collected. If the recipient's age cannot be satisfactorily verified, the order may not be handed over.

It is your responsibility to ensure that alcohol purchased through TheCru.ie is not supplied to a person under 18 years of age.

3. Products & Product Information

We take reasonable care to ensure that product descriptions, photographs, prices and other information displayed on TheCru.ie are accurate.

Product packaging, labels, vintages, designs or other details may occasionally change before the images or information on our website are updated.

Colours and appearance may also vary depending on the device or screen used to view the website.

Where a particular characteristic of a product is important to your purchase, please contact us before ordering and we will be happy to help.

All products are subject to availability.

4. Prices & Payment

All prices displayed on TheCru.ie are in euro (€) and include VAT and applicable duties unless otherwise stated.

Any applicable delivery charges will be shown during the ordering process before you complete your purchase.

We accept the payment methods displayed at checkout.

Payment must be authorised before an order can be processed.

We reserve the right to change our prices at any time. Any price change will not affect an order that has already been accepted by us, except where required or permitted by law.

5. Placing an Order

When you place an order through TheCru.ie, you are making an offer to purchase the goods in your basket.

After placing your order, you will normally receive an automated order confirmation. This confirms that we have received your order but does not necessarily mean that your order has been accepted.

A contract for the purchase of goods is formed when we accept your order.

We may refuse or cancel an order before acceptance where, for example:

  • a product is unavailable;
  • payment cannot be authorised;
  • there is an obvious pricing or product information error;
  • we are unable to deliver the order to the address supplied;
  • we have reasonable grounds to suspect fraud or misuse; or
  • we are unable to fulfil the order for another legitimate reason.

If payment has already been taken for goods that we cannot supply, the appropriate amount will be refunded.

6. Product Availability & Substitutions

All products are offered subject to availability.

If an item becomes unavailable after you place your order, we may contact you to discuss an appropriate alternative where suitable.

We will not substitute a materially different product without your agreement.

If we cannot supply an item and no suitable alternative is agreed, we will refund the amount paid for that item.

7. Delivery

We deliver throughout the Republic of Ireland and Northern Ireland and to selected European destinations.

Available delivery methods, current shipping charges, dispatch information and estimated delivery times are set out on our Delivery & Collection page.

Delivery times shown on our website are estimates rather than guaranteed delivery dates, unless we expressly agree otherwise.

If you need an order for a particular date or event, we recommend ordering as early as possible.

During particularly busy periods, including from mid-November and throughout December, courier networks may experience increased volumes and delays. This can include delays while parcels are processed through courier depots and periods where tracking information does not update as quickly as usual.

Nothing in this section affects any statutory rights you may have where goods are not delivered within a period required by consumer law or within a delivery period expressly agreed with us.

8. Delivery Addresses & Unsuccessful Deliveries

Please ensure that the delivery information supplied when placing your order is complete and accurate.

If an order cannot be delivered because an incorrect or incomplete address was supplied, or because delivery could not be successfully completed, additional delivery charges may apply if the goods need to be sent again.

Where goods are returned to us following an unsuccessful delivery, please contact us and we will advise you of the available options.

This does not affect your statutory rights.

9. Click & Collect

Free Click & Collect is available from:

Please wait until you receive your Ready for Collection email before travelling to the store.

Click & Collect orders will be held for 10 working days from the date you receive your Ready for Collection email.

If you need additional time to collect your order, please contact us before the collection period expires. We will be happy to extend the collection period where possible.

If your order has not been collected within 10 working days and you have not contacted us to cancel the order or arrange additional collection time, we may cancel the order and a 25% restocking fee may apply.

This fee applies to orders left uncollected after the stated collection period where no cancellation or extension has been arranged with us.

The restocking fee does not affect or replace any cancellation, refund or other rights you may have under applicable consumer law.

10. Cancelling an Order Before Dispatch

If your order has not yet been dispatched, please contact us as soon as possible and we will do our best to cancel it before it leaves us.

Please include your order number so we can locate your order quickly.

If your order has already been dispatched, you may still have a statutory right to cancel and return the goods.

11. 14-Day Cooling-Off Period

For most goods purchased online, consumers have a statutory right to change their mind and cancel without giving a reason.

You generally have 14 days from the date you receive your goods to tell us that you wish to cancel.

Once you have notified us that you are cancelling, you generally have a further 14 days to return the goods.

If goods from the same order are delivered separately, the cancellation period generally begins when you receive the final item, lot or piece from that order.

Certain goods and circumstances are excluded from the statutory right to cancel where provided for by law.

12. Change-of-Mind Returns & Refunds

Where you validly exercise your statutory right to cancel, we will refund the payments due to you, including the cost of our standard delivery service where applicable.

If you selected a delivery service that cost more than our least expensive standard delivery option, we are not required to refund the additional cost of that upgraded delivery service.

For change-of-mind returns, you are responsible for the direct cost of returning the goods to us.

You are responsible for taking reasonable care of the goods while they are in your possession and while arranging their return.

You may be responsible for any reduction in the value of the goods caused by handling beyond what is reasonably necessary to establish their nature, characteristics and functioning.

Refunds will be made using the same payment method used for the original transaction unless otherwise expressly agreed.

We will process refunds without undue delay and in accordance with the applicable statutory timeframes. Where goods are being returned, we may withhold the refund until we have received the goods back or you provide evidence that they have been sent back to us, whichever happens first.

13. Damaged, Faulty, Incorrect or Misdescribed Goods

Your rights where goods are faulty, damaged, incorrect or not as described are separate from the 14-day change-of-mind cancellation right.

Please include your order number and details of the issue. Photographs of the goods and packaging may also be helpful where an item has been damaged in transit.

We will work with you to provide the appropriate remedy in accordance with your consumer rights.

Depending on the circumstances, your remedies may include a repair, replacement, price reduction or refund.

You will not be required to pay the cost of returning goods where we are responsible for the return because the goods are faulty, damaged, incorrect or otherwise do not conform to the contract.

14. Exchanges

If you would like to exchange an item, please contact us at orders@thecru.ie before returning it.

Where an exchange is requested simply because you have changed your mind, you may be responsible for the cost of returning the original item and any applicable delivery cost for the replacement.

This does not affect your statutory rights where goods are faulty, damaged, incorrect or not as described.

15. Subscriptions

TheCru.ie offers certain products on a subscription basis.

The price, frequency, contents and applicable delivery arrangements for a subscription will be displayed on the relevant subscription product page or during the ordering process.

By purchasing a recurring subscription, you authorise us or our payment provider to take the recurring payments disclosed to you when you subscribe until the subscription is cancelled or otherwise ends in accordance with its terms.

Where a subscription renews automatically, the applicable renewal terms will be made available before you subscribe.

If you need assistance with an existing subscription, please contact orders@thecru.ie.

Any statutory cancellation or other consumer rights that apply to your subscription are unaffected by this section.

16. Promotions, Discount Codes & Special Offers

From time to time, TheCru.ie may offer promotional prices, discount codes, free delivery offers, gifts or other promotions.

Promotions may be subject to specific terms, including:

  • start and end dates;
  • minimum spend requirements;
  • qualifying products or categories;
  • geographical restrictions;
  • customer eligibility; and
  • limits on the number of times an offer may be used.

Unless otherwise stated, promotional codes cannot be exchanged for cash.

Where specific promotional terms are provided, those terms apply in addition to these Terms & Conditions.

We reserve the right to withdraw or amend a promotion where reasonably necessary. This will not affect orders already accepted under the promotion except where permitted by law.

17. Gift Vouchers

Where gift vouchers or gift cards are available for purchase, any specific conditions applying to them will be displayed with the relevant product.

Gift vouchers cannot be exchanged for cash except where required by law.

Nothing in these Terms affects any statutory rights that apply to gift vouchers.

18. Loyalty Programme

Where TheCru.ie operates a loyalty or rewards programme, separate programme terms may apply.

Points, rewards or other benefits have no cash value unless expressly stated otherwise and are subject to the conditions of the relevant loyalty programme.

We may make reasonable changes to a loyalty programme from time to time. Any changes will be communicated where required.

19. Website Content & Intellectual Property

The content of TheCru.ie, including text, photographs, graphics, logos, designs and other materials, is owned by or licensed to O'Brien Retail Concepts Limited unless otherwise stated.

You may view and use the website for your own personal, non-commercial purposes.

You may not reproduce, republish, distribute, commercially exploit or systematically extract website content without our prior permission, except where permitted by law.

20. Website Availability & External Links

We aim to keep TheCru.ie available and accurate but cannot guarantee that the website will always operate without interruption or error.

We may temporarily restrict access to parts of the website for maintenance, security or operational reasons.

The website may contain links to third-party websites. We are not responsible for the content, availability or practices of third-party websites that we do not operate.

21. Privacy, Personal Data & Cookies

When you use TheCru.ie, place an order, create an account, contact us or sign up for marketing communications, we may collect and process personal information about you.

Depending on how you use our website, this may include information such as your name, email address, telephone number, billing and delivery address, order history, account information and information about how you use our website.

We use personal data where necessary to:

  • process and fulfil your orders;
  • arrange delivery or Click & Collect;
  • process payments through our payment providers;
  • manage your customer account and order history;
  • provide customer service and respond to enquiries;
  • operate our loyalty, subscription or other customer services;
  • prevent fraud and maintain the security of our website;
  • comply with our legal and regulatory obligations; and
  • send marketing communications where we have an appropriate legal basis to do so.

We may share personal data with trusted third-party service providers where necessary to operate our business and provide our services. This may include payment providers, delivery companies, website and technology providers, and communications and marketing service providers.

We do not sell your personal data.

Where we use cookies or similar technologies on TheCru.ie, these are managed in accordance with our Privacy & Cookies Policy and the choices available through our cookie consent settings.

22. Our Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so or excludes or limits any rights or remedies that cannot legally be excluded or limited.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed, subject always to your statutory rights.

If you are purchasing as a consumer, these Terms do not exclude or restrict any liability or remedy provided to you under applicable consumer law.

23. Events Outside Our Reasonable Control

There may be circumstances outside our reasonable control that affect our ability to fulfil an order or cause delays.

These may include severe weather, transport disruption, courier network disruption, industrial action, governmental restrictions, emergencies or other events beyond our reasonable control.

Where such circumstances occur, we will take reasonable steps to minimise their effect and fulfil our obligations.

Nothing in this section removes or limits any statutory rights you may have, including rights relating to delivery.

24. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our business, website, services or applicable law.

The Terms that apply to your purchase will generally be those in effect when your order is placed, except where a change is required by law or otherwise expressly agreed with you.

25. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

26. Governing Law

These Terms & Conditions and contracts entered into through TheCru.ie are governed by Irish law.

If you are a consumer resident elsewhere in the European Union, you may also benefit from mandatory consumer protections available under the laws applicable to you that cannot lawfully be excluded by these Terms.

Nothing in this section limits any rights you may have regarding where legal proceedings may be brought.

Contracts concluded through TheCru.ie are concluded in English.

27. Your Statutory Rights

Nothing in these Terms & Conditions limits, excludes or affects your statutory rights under Irish or applicable EU consumer law.
