Please read this Agreement carefully as it governs your use of the TheCru.ie Online Store website (the 'Site'). By continuing to use our site you are agreeing to the terms set out below and are confirming that you are above the Irish legal age to purchase alcohol which currently stands at 18 years of age. Persons under the legal age to purchase alcohol in Ireland are not permitted purchase, receive, or subscribe to any goods or services from this site.
Provision of Web Site Service
The Site is owned and operated by O'Brien Retail Concepts Limited (Company No: 384671, VAT Reg. No. IE6404671E), (Trading As "TheCru.ie” whose registered office is at O'Brien Retail Concepts Ltd, 94 Millennium Trade Park, Ballycoolin, Dublin 11, D11 NY19.
All material including any intellectual property in it displayed on the Site ("Content") belongs to TheCru.ie or its suppliers. TheCru.ie gives you the right, for your own personal or non-commercial purposes only to (1) retrieve and display the Content on your PC screen; (2) print individual pages on paper; (3) store individual pages in electronic format. You may not store any Content on any server or other storage device connected to an external network or make any other use of the Content.
You may not, without prior written permission given by TheCru.ie within the previous six months, (1) redistribute any of the Content or supply it to other people; (2) remove the copyright or trade mark notices from any copies of Content made under this Agreement; (3) create a database in any form (including electronic or structured manual form) by downloading, copying and storing all or any of the Content; (4) except as expressly set in this Agreement, modify, reproduce or in any way use any of the Content.
Purchases
The prices for goods displayed for sale on the Site are as set out on the Site and are inclusive of VAT and Duty at rates valid as of time of purchase. Where additional charges are made for delivery, they are clearly displayed.
By completing and submitting the electronic order form on the site you are making an offer to purchase goods which, if accepted by us, will result in a binding contract.
By making that offer to purchase goods, you are also authorising TheCru.ie deduct the amount from the card or payment method provided. We will confirm acceptance of your order by email, stating that the goods ordered have been dispatched. This confirmation will be sent to the email address you provide on your order details. Whether or not you receive an email, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion. Where we are unable to fulfil part or all of your order, we will contact you and arrange to refund that amount to you.
Delivery
TheCru.ie offer a national and international delivery, serviced through selected logistics providers. Deliveries are typically made within 3 to 5 working days depending on the time a delivery order is placed. During extremely busy periods our delivery periods may be extended. Where this occurs, we will make every effort to communicate this with you.
Goods must be ordered by and received by a person 18 years of age or older. Where any of our drivers are in doubt as to the age of the person receiving the goods, they reserve the right to request proof of age and / or retain the goods until they can be received by a person of or above the legal age to purchase alcohol.
Cancellation of Orders, Returns & Refunds
You can cancel your order at any stage up to the point of dispatch at no charge. Simply contact us by phone on (01) 4853171 or email info@TheCru.ie. To help us assist you as quickly as possible please quote your order reference number.
You are entitled to a cooling-off period of 7 working days, which begins on the day after you receive delivery of your order. During the cooling-off period, you may cancel your order for any reason. Upon cancellation, we will make the necessary arrangements to facilitate the return of the order and will reimburse you within 30 days. While we are more than happy to help if you wish to return goods that are not faulted or damaged you will be responsible for any costs incurred in returning the goods.
We work hard to ensure that our goods arrive at your door exactly as they left ours. Unfortunately, accidents can happen. In the unfortunate case of goods becoming broken or damaged in transit, we will offer the choice of either a replacement or a full refund including any delivery costs incurred.

In endeavouring to improve the Site and services offered, TheCru.ie reserve the right at all times to make changes to the Content, including these Terms & Conditions. Prices and products are subject to change without notification. You will be subject to the policies and Terms of Service in place at the time of your visit to the Site.
General
There is no specific time limit applying to your access and use of the site. However, TheCru.ie reserve the right to suspend or terminate your access and use at any time. It may exercise the right with or without notice.
You may not assign, sub-licence or otherwise transfer this Agreement or your rights of access to the Site.
Failure by either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy Irish law will apply to this Agreement and both you and TheCru.ie agree to submit to the non-exclusive jurisdiction of the Irish Courts. All contracts that result from the use of this website are concluded in English.

• If you make a purchase using the Website, we will process your email address, your name, telephone number, company name (if you choose to provide it), your address (both for shipping and billing), your order information and, if applicable, any loyalty points you accrue.

Customer Account Registration Information
• If you choose to register a Customer Account with us you will have to provide us with information including your email address, a password of your choosing, your name, your phone number and your address. You may also choose to provide us with the name of your company.
• Where you choose to register a Customer Account with us, we will process your transactional information and purchase history.
Subscription Information
• If you choose to subscribe to our marketing material, we will process your email address and phone number in order to send this to you, but also information about how you interact with the emails and SMS messages you receive from us, such as whether or not you open the communication, the links you click on, whether you purchase anything or whether you opt out of the communications.

6.2 Information you provide to us through the Website is protected by encryption. Unfortunately, the transmission of information via the internet is not completely secure. 6.3 TheCru.ie does not store or process any of your card or payment information. All payment information is processed by third party service providers engaged by us for this purpose, including Global Payments who are Level 1 PCI DSS v3.2 certified.

7.1 The Website contains links to other websites ("Linked Websites"). TheCru.ie is not responsible for the privacy statements or practices on the Linked Websites. This Statement governs only information collected on the Website. When accessing Linked Websites, you should read the privacy statement published on the relevant Linked Website. The terms of our Statement do not apply to Linked Websites. Please check these statements before you submit any Personal Data to Linked Websites.
7.2 The Website contains links to other websites and resources provided by third parties for your convenience and information only. We accept no liability in connection with any Linked Website, or any contract entered into on or through a Linked Website. 10.1 If we amend this Statement, in whole or part, any changes will be posted on this page and, where appropriate, notified to you by email or when you use the Website. The new Statement may be displayed on-screen and you may be required to read and accept it to continue your use of the Website.
